Who owns my generations, and can I use them commercially?

You own your outputs. Per Section 4.4 of Higgsfield's Terms of Use, Higgsfield does not claim ownership of your inputs or outputs, and does not restrict the commercial use of outputs: you can use generated content in ads, social media, brand campaigns, products, and client work. Higgsfield holds a limited license to run the service and to train its models: it ends when you delete your content or your account (with narrow exceptions for backups, publicly shared content, and legally required retention), and deleted content isn't used for training going forward.

Who owns content I generate on Higgsfield?

Per Section 4.4 of Higgsfield's Terms of Use: Higgsfield does not claim ownership of your inputs (prompts, reference images, audio) or your outputs (generated images, videos, audio), and does not restrict the use of outputs for commercial purposes. This applies to all users of the Service. Separately, Section 4.2 states that Higgsfield does not claim ownership of Your Content broadly.

Can I use generated content commercially?

Yes. The Terms of Use do not restrict commercial use of outputs. Commercial use includes advertising and paid campaigns, social media content for brands, client work and deliverables, products that incorporate AI-generated visuals, YouTube monetization, and brand marketing materials.

There is no separate commercial license to purchase: commercial use rights follow from the Terms of Use for all users.

One practical consideration: if your plan includes watermarks on generated output, those watermarks are embedded at generation, and publishing watermarked content in commercial contexts may not be appropriate depending on your use case. What license does Higgsfield have to my content?

Per Section 4.3 of the Terms of Use, you grant Higgsfield a non-exclusive, worldwide, royalty-free license to host and process your content, limited to operating, providing, and maintaining the Service. It lasts only while your content is on Higgsfield and ends when you delete the content or your account, with narrow exceptions: routine backups, content you shared publicly, and retention required by law. Per Section 4.4, Higgsfield may also use content to train and improve its AI models. You can stop this going forward by deleting the content or your account, and on Enterprise agreements customer content isn't used for training at all. Marketing is separate: Higgsfield features only content you've made public, or uses your content with consent.

These licenses don't transfer ownership of outputs to Higgsfield and don't restrict your commercial use.

Are there restrictions on what I can generate or publish?

Section 5 of the Terms of Use sets out restrictions on user conduct and content. Relevant to commercial use: You may not use the Service or outputs to train, fine-tune, or improve any AI or machine-learning model, whether or not it competes with Higgsfield (Sections 5.1(iii) and 5.2(iv)). The exception: models you train with your own inputs, not with outputs of Higgsfield's models, or with Higgsfield's written permission.

You may not conduct commercial activities through the Service itself, such as contests, sweepstakes, or barter, without Higgsfield's prior written consent (Section 5.1(ii)(e)): this applies to activities run through the platform, not to publishing generated content externally. You are responsible for ensuring your content does not infringe third-party rights, including copyright, trademark, and likeness rights (Section 5.1(ii)(b)), and you may not upload or use an image of another person without that person's permission (Section 5.3).

Can I sell AI-generated content?

The Terms of Use do not prohibit selling generated outputs. The restrictions in Section 5.2 apply to commercially exploiting the Service itself, not to downstream use of content you generate through it.

Yes, per Section 4.4, unless you're on an Enterprise agreement, where customer content isn't used for training. Deleting content or your account stops training use going forward. Ownership isn't affected: your outputs stay yours.

No. Sections 5.1(iii) and 5.2(iv) prohibit using outputs to train, fine-tune, or distill any AI model, competing or not. The only exceptions are models you train on your own inputs, or uses Higgsfield has approved in writing.

Yes. Rights in outputs you've generated and exported survive cancellation and account deletion, and you can transfer or sublicense them to clients (Section 4.4).

Submitting work to a contest, campaign, or showcase makes it public, so Higgsfield can feature it, and separate contest terms may apply (Section 4.7).
